2. Scope of These Terms
These Terms and Conditions apply to all commercial transactions made through our website, www.tipperarystoves.ie. They must be read in conjunction with our Refund and Returns Policy, Delivery Information, and Privacy Policy. Nothing within these terms limits, modifies, or excludes your statutory rights as a consumer under Irish law, including the Consumer Rights Act 2022.
3. Products, Specifications, and Availability
- Product Descriptions: We make every effort to ensure that all product descriptions, technical specifications, and measurements are accurate. However, digital images are for illustrative purposes only; actual product colours, finishes, and textures may vary slightly from how they appear on your screen.
- Pre-Purchase Verification: It is the customer's responsibility to verify product specifications, dimensions, flue requirements, and spatial suitability before finalizing a purchase or arranging installation.
- Stock & Lead Times: All orders are subject to stock availability. Certain items may be placed on back-order or carry extended manufacturer lead times. If an item you ordered is delayed, we will contact you promptly to advise you of the estimated delivery timeline.
4. Pricing and Payment
- Currency and Tax: All prices displayed on our website are listed in Euro (€) and are inclusive of Value Added Tax (VAT) at the prevailing Irish rate, unless explicitly stated otherwise.
- Additional Fees: Delivery fees, custom structural alterations, or separately contracted installation costs are not included in the baseline product price and will be clearly calculated and displayed before you complete your order.
- Payment Processing: Full payment must be cleared using one of our authorized checkout payment methods before goods are dispatched or services are scheduled.
5. Order Acceptance and Contract Formation
- Order Acknowledgement: When you place an order online, you are making an offer to purchase the selected goods. The automated email confirmation you receive immediately after submission acknowledges receipt of your request but does not constitute formal acceptance of your order.
- Contract Finalisation: A legally binding contract is established only when we issue an explicit dispatch confirmation email or when physical delivery of the goods commences.
- Order Cancellation by Us: We reserve the right to decline or cancel an order at our discretion prior to dispatch if:
- The product is unavailable or out of stock.
- A clear pricing error or incorrect technical description occurred on the website.
- Payment authorisation fails.
- Safe delivery to your location is logistically impossible.
If an order is cancelled after payment has been processed, a full refund will be issued immediately to the original payment method.
6. Delivery and Collection
- Territory: E-commerce delivery services are restricted to addresses within the Republic of Ireland.
- Shipping Rates: Shipping is free of charge within the Republic of Ireland
- Timelines: Delivery times vary by product. Typical delivery is 3–5 working days for stocked items. Larger appliances, special-order products and items awaiting supplier stock may take longer. The estimated delivery time will be shown on the product page or confirmed before dispatch.
- Transit Damage and Inspection: You are required to examine all packages immediately upon receipt. Any visible transit damage, missing items, or delivery discrepancies must be reported to us within a reasonable timeframe (ideally within 48 hours), accompanied by photographic evidence. Failure to do so does not impact your legal statutory rights regarding inherently faulty goods.
7. Statutory Cancellation, Returns, and Refunds
- 14-Day Cooling-Off Period: Under EU and Irish consumer law, customers purchasing entirely online or via telephone have the right to cancel their contract within 14 calendar days of receiving the physical goods without providing a reason.
- 30-Day Extended Return Policy: In addition to your legal rights, Tipperary Stoves offers an extended 30-day voluntary return window. Goods returned under this policy must be entirely unused, uninstalled, free from damage, and inside their original, pristine packaging.
- Exclusions: Custom-built items, custom-cut replacement components (such as custom-sized glass or bespoke vermiculite bricks), fully installed products, or completed service contracts are exempt from standard return terms, except where statutory faults exist. Return shipping costs are the responsibility of the customer unless the product is deemed defective.
8. Faulty and Non-Conforming Goods
We are legally bound to supply goods that conform to the sales contract, are fit for purpose, and are of the quality and durability that a consumer can reasonably expect. If a product develops a fault, arrives damaged, or is not as described, please notify us immediately. Depending on the nature of the issue and timeline, remedies under the Consumer Rights Act 2022 include repair, replacement, price reduction, or a full refund. These statutory protections operate completely independently of any commercial manufacturer warranties.9. Professional Installation and Field Services
- Service Scope: Site surveys, chimney relining, structural fireplace work, and general stove installations are only included in the contract if explicitly itemized in a written quotation or order confirmation issued by us.
- Site Variations: Installation quotes are based on preliminary assessments and customer disclosures. If unforeseen structural challenges or non-compliant flue issues are identified on-site, any necessary additional work and extra costs will be discussed and agreed upon with the customer before the project continues.
- Access and Preparation: The customer must ensure safe, unobstructed access to the property at the agreed time.
- Third-Party Contractors: Any heating appliance purchased from us that requires specialist installation must be fitted and commissioned by a certified, competent professional (e.g., a registered HETAS or solid fuel installer) in strict accordance with Irish Building Regulations and the manufacturer's manual. Tipperary Stoves accepts no liability for defects, operational failure, or structural damage resulting from incorrect installation by a third party, general user misuse, or a failure to perform routine maintenance.
- Unlawful Exclusions: We do not exclude or limit our liability to you where it would be unlawful to do so under Irish law. This includes liability for fraud, fraudulent misrepresentation, or death and personal injury resulting directly from our corporate negligence.
- Foreseeable Loss Only: We are only responsible for losses that were a reasonably foreseeable consequence of a breach at the time the contract was formed. We are not liable for business-related indirect losses, loss of profits, or secondary damage resulting from domestic heating interruptions.
